Joe : Thanks for posting. It is clearly a dead tree that should have been taken out a while back. When I look up at the tree line there are lots of dead trees along our roads. I think it's dangerous for the people using the roads. Also, Is it neglect they haven't been removed? Next question, who is responsible, the trails associations? I wonder if they are risking being sued if someone is killed by a tree that clearly should have been removed.

Oh wow! I bet it was one of those that was damaged during that big wind storm we had some time ago, and this strong wind gave it that last push? Thanks for the info, Joe

TEXASGIRLMAMMA :
Not sure about the legal issues, but the dead trees are definitely a problem.
I've mentioned this a couple times, but a KDC employee's husband was driving to work one day and had a tree fall on his car on Kingwood Drive, causing a pretty bad spine injury and totaling the car.

Joe :
Thank you for the heads up. Hopefully it will be cleared away soon, it's a shame that it wasn't taken down before this could happen. I see a lot of trees leaning toward the road along KW Drive every day that make me a little nervous.

Insurance companies will claim act of God. A documented communication, such as email, prior to an accident will provide negligence by the owner of property owner within time. Not sure but I believe 12' clearance is required over public roadways.

I think you should attend the community forum being sponsored by Fred Flickinger tomorrow night and ask these very valid questions. It is a dangerous situation.
