Visa and mastercard debit cards do not allow it either, the companies will take action if notified, as the Texas AG. Laws against extra charges for credit card use exist also, they are just not as enforceable due to federal laws. That why you see gas station posting cash and credit prices.

A lot of businesses are charging the cost of using cc card on the customer. I always use cash. We always ask before using a CC if they charge for that. This is more common than you think.

I won't go to any place that charges for credit card use, I never use a Debit card EVER and I cut them up the minute the bank sends me a new one.

Almost every business has pricing based on the "cost of doing business" so that extra 3% is baked in so most places that charge that extra 3% for credit are likely double dipping. And if a business doesn't price things this way they should because the overwhelming number of people pay with a credit card mainly because so many people these days live beyond their means. All major retailers base their pricing on credit card use.

As for the gas stations offering "Cash" and "Credit" prices they are also crooks who are double dipping because if you pay attention they are always more expensive than stations just a few blocks away where you can't see the signs which means they aren't giving anyone a break on anything.

Cash is mostly used by illegal immigrants who have no bank account and those people who have a side hustle or even a main job that pays in cash and they are just avoiding taxes.

If I have to go to an ATM machine just to have a donut without an upcharge, I will just not buy a donut. Or maybe I'll go next door and just get a breakfast taco at the meat market. It might cost more but will also feel like I am getting what I pay for.

Can we make a list of KW donut shops that don't charge more for the convenience of buying donuts without going to an ATM first?

There are a lot of "shady" things going on with businesses now. I usually go to the Exxon by LaMadeline because with Walmart+ I am supposed to get a discount on my gas there- and have for quite a while. But they have disabled the feature that allows that option to work since gas prices have gone up. I go to HEB even if the gas is the same price. I won't patronize businesses taking advantage of customers especially with groceries and gasoline and the entire cost of living so high at this time.
