Your thoughts.....
Been with a company almost 10 years (bonus due)
Worked up from entry level to General Manager
A lot of compliments from customers and upper management
Over summer other two section managers out
Busiest time of year and you do those jobs, on top of own
In August you are told to hire two employees per week with strict
Tight perimeters (pay and availability)
Able to do 5-8 interviews per week, weeded out from 20 apps, hired about 1 a week. Applicants wanted $18-20 an hour for entry level and availability was narrow. So very few applicants fit the hiring perimeters set up by directors
September directors come in and fire you for not performing up to expectations. (Specifically did not meet hiring goals) You have worked 60+ hours a week with compensation for only 40 (salaried). No separation papers, no severance.
It is known that the company is in financial hurt. She feels like a scape goat.
Can she request a copy of your personnel file and letter of separation?
Family owned business with six locations. Not only did she lose a job she put her blood sweat and tears into, and loved; she lost her identity. She feels blind sided. She thinks there is more to this because it seems it seems planned and she was set up to fail.

Sounds like a set-up to fail for easy termination, maybe age discrimination.

Did this happen to you?
Are you trying to get a copy of the termination documentation or worried they will share with a potential future employer?

I would immediately file for unemployment, relay exactly what they did and force them to justify it or pay unemployment.

Request documentation of proof of employment. Expect pushback from employer . Be respectfully persistent. Praying for you.

rebadawn :
I would consult an attorney. Especially, if age is an issue. Totally, set up to fail. Nowdays, employers need plenty of documentation to justify termination. The exception would be mis-conduct which is not the case here.

#msg6019490Can she request a copy of your personnel file and letter of separation?

rebadawn : Sorry to hear this…losing a job is rough, especially if it becomes a big part of your life.

Regarding requesting info: Of course, she can request anything, but it's up to the company if they comply.

I'm not sure what you're looking for. If you feel there is discrimination, maybe, but it's super hard to prove. Texas is an at-will work state, so they could fire you pretty much for any non-discriminatory reason…if they don't like the color of your shoes, for example. Or, like you mentioned, if they are hurting financially.

From the details given, you should be safely able to collect unemployment insurance, so that doesn't seem to be the issue.
