MEDIA RELEASE - For Immediate Release – 5.21.24

Officer Involved Shooting

On Tuesday, May 21st, at approximately 8:20 a.m., a Montgomery County, Precinct 4 Deputy conducted a traffic stop at the Fuel Max located at the corner of Valley Ranch Pkwy. and Azalea Blvd. in Porter, TX. During the stop, the Deputy discovered the passenger in the vehicle, identified by his TX ID card as Jeremy Hebert, 19, from Palestine, TX, had an outstanding class C warrant in Montgomery County for Failing to Stop or Remain Stopped. Additionally, he was wanted in Louisiana for Contributing to the Delinquency of a Minor, with full extradition.

When the Deputy asked Herbert to exit the vehicle, Herbert fired a shot towards the Deputy and fled on foot into the nearby Valley Ranch Subdivision. Multiple agencies responded to establish a perimeter. Montgomery County Sheriff’s Office SWAT and the Montgomery County Fire Marshal’s Office drone pilots joined our drone, "Eagle 4" in the search.

The suspect was located by our drone pilot and "Eagle 4" hiding in a backyard on American Yellowwood Place. Luckily, this stopped Deputies from walking into a potential ambush. Surrounding the backyard from adjacent properties, Deputies confronted Herbert as he raised his weapon. Two Precinct 4 Deputies discharged their weapons, stopping the threat. Life-saving measures were immediately administered, and Herbert was transported to a local hospital where he is currently in stable condition.

Jeremy Hebert is facing several charges, including three second-degree felony charges of Aggravated Assault on a Peace Officer with a Deadly Weapon, misdemeanor Evading on Foot, and misdemeanor Unlawful Carrying of a Weapon. He currently has a bond total of $227,000.

The driver of the vehicle, identified by her TX Driver’s License as Sarah Frame, 28, from Conroe, TX, was charged with state jail felony Possession of a Controlled Substance, third-degree felony Possession of a Controlled Substance, and two misdemeanor possession charges. She is facing a total bond of $4,500.

The Montgomery County District Attorney’s Office and the Texas Rangers are investigating the incident.

Constable Hayden extends his gratitude to all responding agencies for their assistance, including the Montgomery County Sheriff's Office (patrol, SWAT/drone, PIO, Crime Scene, and Homicide/Violent Crimes Detectives), City of Patton Village Police, Roman Forest Police Department, Montgomery County Fire Marshals Office, Texas Department of Public Safety - Southeast Texas Region, Montgomery County Hospital District and the Porter Fire Department. He also commends the heroic actions of our drone pilot, whose quick thinking and skillful operation of "Eagle 4" prevented further danger to our Deputies.

TownHubAdmin: it's time to say guilty until proven innocent- especially in cases such as this.

Just saying - Maybe increasing shooting range time with emphasis on the vital organs would be beneficial to law enforcement.

Gammyof2:
We get to do that.

It's only the justice system that's obligated to presume innocence (though they can and do consider community safety in release/detention decisions).

I'd like to know more about this POS's injuries sustained when officers stopped the immediate threat.

TownHubAdmin :
Seems like they severely under-charged him. It's an attempted murder. Shooting at someone with a lethal weapon is attempted murder, all day every day.

Govchance : I agree, any shooting of a public servant should be but its not. I saw where a guy in California shot at a police officer, he got 118 years, a life sentence & then some.

Maybe they should have had some major " Commutation Issues with their Emergency Services " while they were working to save that POS. I will be shocked if that POS gets out and continues to be big problems.
