Appears perhaps a litte payola was remitted to a court officer (aka judge) for being creative with this sentence.
I read that he went to KHS at the time of the accident and the girls went to AHS. A jury acquitted the store clerk. Someone posted on the Atascocita message board an article from I believe the Houston Chronicle and this information was in there.
I worked as a healthcare professional at the Harris County Jail for 7 years doing intake evaluations and inpatient mental health care. One thing I learned from my inmates is that probation is difficult. Some of us used to think it was just a "slap on the wrist" easy sentence. It is not! You have to report to your probation officer as often as assigned, take drug tests, sometimes attend drug and alcohol rehab, lose your drivers license or have a device installed that detects any drinking, and remain "on paper" for 10 years. Any violations and you get sent back to jail or state prison. Some of our repeat offenders and those with mental illness just wanted to serve their sentence in jail because probation was too hard. Doing 120 days means reporting for 6 weekends a year for the next 10 years…difficult for a young man just starting his life. He will be doing a lot of explaining and education to his employers , coworkers, friends, girlfriends, etc. for a long time. This is not to diminish the severity of his crime or my sincere sympathy for his victims. I just wanted to share what I heard about sentencing from those who lived it.
Being locked up on the anniversary of the victims' death seems unusual. Cruel and unusual punishment is unconstitutional. I'm not saying he doesn't deserve jail time, just that these judges should follow the law of the land.
