No, I do not agree at all. A front door doorbell is a common and accepted place for a stranger to approach a house regardless of time of day or night. If you do not want anyone there, you better fence and lock your property.
I'm wondering if the parents might bear some responsibility here? It is THEY who did not monitor this child. At that late hour and roaming the streets? Totally irresponsible and maybe even child endangerment?

The shooter and the child's estate can sue them for damages.
PatrickStar : It's this kind of thinking and dismissing of bad behavior that has bought us an entire generation containing many kids completely out of control, with zero respect for authority, committing crimes and filling our jails because they were allowed to escape discipline and consequences.
I can agree to a point. BUT the colossal error this homeowner committed is once, according to reports, he was no longer under threat, as the perps were running down the street, it then became a murder.

PatrickStar : This was not a 5-year old that just wandered onto the property. This was an 11-year old, intending to cause mischief at the very least. He knew it would cause surprise, shock and possibly fear given the time of night. He made a choice and that choice was the catalyst for the entire course of events. He did not deserve to die because of it, but he made a choice and took a calculated risk to do something he knew was wrong. He is not solely responsible but he does bear some responsibility, as do his parents, as does the homeowner that discharged his weapon.
Before you hoist that flag too high, I'd suggest a brief detour through the shooter's arrest record. Just a glance. Or don't. It is, after all, a free country. Still, perhaps, for everyone's sake, we all might simply agree to disagree and move on with our opinions?
Texas law allows fencing regardless of HOA regulations as of 2021.
PatrickStar : Many areas don't even allow a front yard fence as part of the HOA. Not sure where this was exactly.
"Child endangerment in Texas is defined under Texas Penal Code Section 22.041. This law addresses situations where a child is placed in imminent danger of bodily injury or death due to the actions or omissions of a caregiver. Here are the key elements of the law: Types of Offenses
Endangerment: A person commits an offense if they knowingly, intentionally, or recklessly engage in conduct that places a child in imminent danger of serious bodily injury.
Abandonment: Leaving a child in a situation where they are likely to suffer harm can also constitute endangerment.
Penalties
Class A Misdemeanor: Generally, child endangerment is classified as a Class A misdemeanor, punishable by up to one year in jail and/or a fine of up to $4,000.
Felony Charges: If the endangerment results in serious bodily injury or death, the charges can escalate to a felony, leading to more severe penalties.
Factors Considered
The age of the child, the nature of the danger, and the caregiver's intent are all considered in determining the severity of the offense.
For specific cases or legal advice, consulting a legal professional is recommended.

I don't know if any of you remember or are aware of a case in Minnesota where these two kids repeatedly broke into a man's house. Well, the short version is he pretended to leave the house that day. Parked his vehicle around the corner so that the kids wouldn't think he was home. Sure enough, a teenaged boy and girl broke in. He audio recorded himself killing both of them. He was convicted of murder. Now, much like here there were arguments that had the kids not broken in they'd still be alive. However, a jury concluded that the man went too far. www.nbcnews.com/news /us-news/minnesota-h omeowner-byron-smith -convicted-prem
