MissAmericanPie : No, I don't think they do. There was a home in my neighborhood that was just awful and it went on the 10 or 15 years.
MissAmericanPie : I've been wondering why they didn't cover up the damaged area with a tarp or something when they had the fence installed. While it's certainly an eyesore, it has to be a hazard for so many reasons, and I feel badly for the neighbors that are close to that property.
mellen: Any lending institution that filed a 3rd to 7th mortgage on a property shouldn't be in the mortgage lending business. IMO, they don't deserve to get their $$ back.
MissAmericanPie : The legal process for the HOA to take action is long. They can't just go onto a property.
GoldenGirl : Thank you for your comments. Unless you have been on an HOA board, you've no idea of the process. Sending a move trash or mow lawn letter is the first step. As annoying those letters are, they serve to keep our neighborhoods nice.

bigcity : The lenders and holders of the 3rd thru 7th were not instuations but individuals. The crooked lawyer was the one who handled all of the paperwork, so they were unaware of the number of liens or what position they were in.
MissAmericanPie : You have to think about it. If they tear it down Pennywise will just move back into the storm drains and cause havoc again. The corporation knows what it's doing. 😉
Solution to this is easy. HOA has it torn down and hauled away. HOA maintains the grass on the lot weekly so it's not an eyesore. HOA places a lien on the property so that when this company that owns it tries to sell the property the HOA gets it's money back. If they don;t sell it soon enough the HOA has the legal authority to foreclose on the property and they can get the money back that way. My neighbor here in Sand Creek has some kids toys in his driveway. My property is spotless but I repaired a fence and I had 15 old fence pickets bundled up neatly next ton the garage waiting for garbage day to put them out. Both he and I received warning letters that we had to clean up our "clutter". Yet a home like this is left for over half a year now. No bueno.
Ticagro : Also the Elm Grove apartments has a section that burned years ago that they haven't done anything about either.Sherwood Trails has a house across from the Elm Grove pool that took a tree across the garage many years ago that is falling apart and hasn't had anything done about it.

bigcity : Are you kidding? They would love that. The more loans, the more money they make. You can be upside down on a house too and still have to pay that mortgage.
Ticagro : Due to Texas law the HOA cannot step foot on the property without the owners permission.

Ticagro : I would say i see the necessity of hoas, but some of them are so poorly run its ridiculous. My buddys hoa in kingwood has been in the red since covid. Yet the prop manager still makes 80k a year in salary and hascfailed to even maintain public spaces. Then the assessments go up every year. That kind of behavior makes people hate hoas because we see our money is wasted by incompetent people.
I can't believe this….so I'm out cycling this morning and I'm riding through Elm Grove on Sycamore Springs and that house that was demolished last year in Beryl is STILL just sitting there like the day it happened. I know it's a rental home owned by a company, but how do they get away with this? The HOA Regs apply to them like anyone else. Yet….
MissAmericanPie : Probably no insurance on it, they probably going to walk on that property. HOA's need to do a better job regulating the rent houses in their neighborhoods. « Back to Chat
