Detainment is part of normal procedure in this type of incident, they would want to test them for a number of things, including gunshot residue, immediate state of mind,,etc. The Castle Doctrine gives one the right to protect their home and family.

I think the intruder has to have crossed the threshold and you have to feel threatened. Then I think it's tough for police to argue such a shot.
This is an odd one, as they often Are. Could be a known subject, to the homeowner. Perp made his way into the house from the back yard, in ski mask and dark blue hoodie. Homeowner chased perp outside, and then, eventually, homeowner returns to his home. Now, this is the Interesting part: perp comes Back into the house, and homeowner gets his firearm, and fires on the perp. Perp flees, but dies on easement behind the home he was trying to enter. Hmmm--you chase him out, but Follow the perp. Perp comes Back, after being chased out. Homeowner then gets a firearm and shoots the perp, who dies from his injuries. Who Chases a perp down the road? What perp comes Back, after being chased out? I'm thinking drug deal money involved; who was owed it, who had it, etc, etc etc! This is why LEO interviews and does so much investigation, from the jump.
