After reading this article I think they should just cut the grass and vegetation so the home owners can have their view back. Kind of deceptive to have the propert manicured so they can sell the property, then not cut it after this couple built their house. I looked at the photos, they have a nice view. They don't have lakefront property those and it seems that the HOA decided to let a chunk of former common area go into reserve area status so that the developers could continue to build in the area. The HOA offered a five foot wide easement to be maintained giving the people clear access to the waterfront and the people declined that offer. The neighbor didn't do anything wrong other than buy the lot that was closest to the waterfront.
 
If you don't actually own the adjacent property, you don't have a lot of control over what happens to it. The article didn't mention if they had it in their contract that the adjacent property was to always be maintained as common area and not developed further or returned to reserve status.
 
I hope they are able to get some sort of acceptable resolution. it sucks to think of your home as a nightmare. 4951

there is a texas state law,, which states
if a person takes care of land for several years, (cutting cleaning, etc,,, must take care of it for years,, have witnesses and show proof they did) and when a person or company wishes to purchase or build on such land (public or unkown owner),, they must offer to buy the land rights from the person who owned the land.
 
I would cut the grass every other day, make it look nice,, take pictures, tell the neighbors,,, and do all kinds of fixing up,,, then when they try to improve the lot,, ,make a legal claim of ownership,, since nobody else is taking care of it...
 
find the law,,, it takes a lot of work 4951

@KellyG I think the photos are at a bad angle. The homeownere should have checked prior to purchasing what the deal was with the property (we did that when we saw an empty lot  on KWD in front of Sand Creek, and walked when we found out it was zoned commercial). Royal shores shouldn't have mainted the land while selling the lot.The neighbors are definately **** clowns. Real brats for putting up that sign right in front of the homeowners. 4951

@KTownTexican: urban myth. The adverse possession provision is way more complicated and convoluted than that.

TExINS I find it very odd you are attacking the neighbors when the article mentions very little about them and is primarily focused on the HOA. Have a personal interest in this situation?
 
If they/you wanted lake front property, they/you should have bought lake front property. They/you do not own the property next to their/your house and have no say what should be done with it. Move or stop complaining. Should have taken the deal they/you were given (5' wide strip mowed down to the lake) 4951

My sympathies lay with the Currans in this situation. It is obvious that they were misled by the fact that the common area was maintained to make the view and the access to the lake an important part of the value of their property. What, if anything, has changed since then? Why should they now accept an access of only 5'? Will they also receive a refund on the purchase price of their property? It was dishonest to represent the access area as a regularly groomed and maintained piece of land before their property purchase and the building of their home, only to be posted later as a "restricted reserve" with no mowing or cutting allowed. I'd be interested in knowing what the legal definition of this status is, as well as when the area was designated as such. I would also like to know why the existence of Chinese Tallow is not considered an influential factor in maintaining the ecosystem of this "reserve". This is a non-native plant that wreaks havoc on the local vegetation. A single specimen puts out 10,000 seeds. "...they grow much faster than trees native to Texas. In China, moths and
other predators keep them in check. But here, native animals and insects
don't eat them, and neither will cattle. Grasslands, wetlands,
established forests: Tallows devour them all." ("Gray: The Tree That Ate Houston" by Lisa Gray, Houston Chronicle, March 15, 2010) It seems that the Royal Shores HOA is more interested in indulging its own control issues rather than the biological balance of this so-called "reserve". The board members' bad attitude towards the Currans' situation is obvious considering their rude and disrespectful treatment of the Currans' attempts at contact with the Royal Shores HOA. Filing a law suit would be the Currans' last resort for some sort of redress in this matter. That is their right as American property owners. 4951

@Reedlette:
I don't disagree that the hoa is on a power trip at all and needs to be sued. I just like tallow trees. They don't really destroy vegetation but if that can be used to get the area mowed, go for it.
