about a 2 minute interview with the dude who was the "carjack" victim at the shell station where the guy was shot the other day.Anyone see it beside me?The lead in said they ran the plates on the motorcycle and the plates "were bad".Nothing about a robber.Mr. Joe (who channel 13 said he was) then told his story.Shorten version, I'm sure you could go on their web page to see the segment if you desire.He said he was in the car wash, and saw this guy running through the car wash.He opened his car door and confronted the guy.The guy said no and from the visual presented placed his hands on Mr. Joe's shoulders.That is when the cop tazed him.Mr. Joe said he was down on all fours when he reached into his backpack and pulled out a gun, and pointed it at the cop.The cop fired twice and killed him.Now nothing about a carjacking, in his version.The picture of the body (yea, I looked at it) showed the body out in the open, not in the carwash.I would think they would not move the body until the investigation was complete, so that could be a discrepancy in the story.Mr. Joe they said was 70 years old. 4951

Why would you even open your door in a car wash if someone was coming thru.  I probably would have presumed it was a worker.  I wouldn't have stepped out to confront them.  And yes, the picture of him was outside more toward the front end corner of the store. 4951

Should I?  Would it be entertaining to create a firestorm?   Should I give the usual suspects an excuse to accuse me of law enforcement hatred or of simply arguing for the sakes of arguing? You either didn't watch the video or continue to have poor comprehension skills.  The man said he opened his door to attempt to stop the man who wrecked his bike from running through the car wash.  He never indicated the fleeing suspect attempted to carjack him.  4951

Well it appears it wasn’t an attempted car jacking by the witness’ 1st hand account. Anything on the identity and back ground info in the deceased that would explain why he had bad plates and flee from cops?
@e: Why the person fled will remain a matter of speculation because the only person that could give any certainty will never speak on the matter.  However, it is reported there was a warrant out calling for the person's arrest.  If the person knew that fleeing was the only option if confinement, at least temporary. was not acceptable.  A second possibility seems to have been that the motorcycle was in the possession of the rider by virtue of a crime that was about to be discovered if the presentation of registration documents was made.  A matter of the guilty state of mind creating flee provoking fear.  It is doubtful bad plates alone would.  That alone is not that serious. Here is where I will get lambasted.  The attempted "carjacking" victim does not describe the elements of a robbery, the correct term.  If anything he assaulted thee defunct and that person stood his ground.  Of course, I am not suggesting the DA charge that person for assaulting the defunct or all the subsequent things that ensued.  A truly nutty DA could think assault, dead dude, felony murder which absolves the deputy.Was a weapon recovered at the scene?

@plakata: An important detail that has not been made public by officials.I have heard no weapon (from friends of the deceased, so biased source) and yes, there was a weapon (from people claiming to have talked to witnesses, so also not too credible).  Then there is the witness in the interview claiming to see the gun.
@teatime: That is part of the problem with wild speculation on sites such as this one.  A witness reads and memories are altered, however slightly, after all, they often want to please.  My career includes 1 bank robbery case, defense, not perpetration. The divergence between what was filmed and witness accounts was stark. I will assume a weapon was recovered but if one wasn't what did the lay witnesses see.  The evaluation is or should be different than for a highly trained professional law enforcement officer.  I refuse to speculate but this may turn into a Houston/Harris County professionals vs. Montgomery County Barneys.  It should not be but it is in Houston's and Harris' jurisdiction. with the Rangers' assistance.  I know some will call it hating law enforcement but life is real, not a prance through a tulip field.  I would not want to be in the deputy's situation IF a weapon was not recovered at the scene.  I capitalized the IF because it will be that big IF one was not when the Harris DA decides what to do.  I'm aware of the whole the lesbian hates cops theme but IF no weapon was fund...what was the fear that justifies the use of deadly force based on?

@teatime: And the entire incident (at least at the point where it ended--the Shell Gas Station) should be in video. One thing is for sure, and a FACT: Why run from the Law? Unless one has a good reason to run. I was not there and can only speculate and wait until all the distorted news come out. It seems the true witnesses are being suppress from speaking about what they saw, and recorded. Why?  4951
