My daughter, in her neighborhood stopped in front of the mail box bank on the left side of the road so she was facing oncoming traffic with her hazards on..a guy was backing out of his driveway on the right side and backed into her. Does the fact that she was parked facing the wrong direction have a bearing on fault?
 
It did quite a bit of damage.

I know you can get a ticket for parking in the wrong direction so not sure if that will be her fault or not.  Good luck. 4951

I would think being parked and somebody backing into her would put the blame on the backer. I don't think being the wrong way gives anybody the right to just slam into you. Of course it will be a he said / she said. Any pictures I hope? The insurance company should be able to wrestle it for her if she goes that route. 4951

@BooBear: My experience is no but for sufficient amount of money a lawyer argues otherwise.  She will be a victim of the claim settlement conspiacy.   Her premiums will go up irrespective of fault and all in her pool will experience a smaller hike @Cador can explain how brokers'  earnings suffer because of that.  That was my Twitter persona.

@mulmye: her insurance may get dinged but she wouldn't be out her deductible. thats what she is worried about, paying that $500. It was a young kid in an old truck, his dad was listed on the policy, not completely sure if the kid was or not. That info is based solely on the info she got from him. She hasn't called either insurance company.
