It is a violation of the Texas Public Information Act to release any likeness of an individual if that person has not been convicted. Shame on the Constable. He should know the law.

From the smile on her face, she knows she will not have any consequences and ultimately won't be held accountable.

TownHubAdmin : she and every drunk driver should be forced to listen to the families of victims of drunk drivers. They should watch the old videos from drivers education of the 60's/70's that show what happens when they take other peoples life's. I've lost way too many people to drunk drivers/impaired drivers. It is sad. They, the drunk or impaired driver, rarely get a scratch.

I see a DUI fatality in her future. Either her or an innocent driver

Yeah, that exactly what I think. I think they get away with it cause no one challenges them on it. You can look it up if you want. Its Texas Government Code chapter 552. Go to the TX AG's website. They have a Public Information handbook there.

I dont have to. Its wrong nonetheless. You seem to think its ok anyway. Isnt that supposed to be part of our constitutional rights? Innocent until proven guilty? The good Constable seems to think its ok to put these folks on blast, no matter the outcome of their cases. I think its ********.

I agree and I also think you should have all your rights reinstated after you serve time. It's no wonder most return to a life of crime when we make it hard for them to get a decent job.

ComingInHot : There's this:
In the state of Texas, mugshots and other arrest information are public information. And due to documents like the Freedom of Information Act, there can be no Texas arrest laws barring the publication or distribution of that data.

MissAmericanPie :
You are wrong. In a former life, I filed TPIA requests daily. There was an exemption (there are dozens now) placed in the TPIA sometime back in the early 2000s that excepts the likeness of a person charged with a crime from being released before that person has pled guilty or has been convicted. I got a letter from the AG telling me I was **** out of luck. You can look it up if you want. BTW, the FOIA doesnt have anything to do with State agencies. The Constable operates under Texas law, not Federal law.

Do you REALLY think law enforcement agencies of the state of Texas would open itself up to lawsuits by defying its laws? Public records are just that, public.

I looked it up. It's not illegal to post them but I agree they should not be posted prior to conviction. Posting the pictures is intended to be putative and to act as a deterrent to people knowing they may be publicly humiliated. The problem is if they are not guilty that picture is out there forever. They do this regularly to call out Johns when they do prostitution stings.
