My question is, since this has failed does she go free? Something like Double Jeopardy? I have not heard anything. I would guess that is a states decision/ruling
UptownGirl : No, she will not go free. Her sentence is considered incomplete and she will remain in custody. The Supreme Court ruled in 1947 that a second attempt at a botched execution does not violate cruel and unusual punishment or double jeopardy, so I expect they will either obtain a new death warrant (setting off a tsunami of legal challenges) or just commute her sentence to life without parole.

Capybara : I have heard discussions about the electric chair being considered next as well as possibly lifetime sentence. Stay tuned I guess.

UptownGirl : The other guy, in that state, who survived his execution is still alive and living in prison. So, I think that will be the case with her.

Saw were Hegsteth and Trump signed off for a firing squad for the Fort Cavasos ( formally Fort Hood) Doctor who killed some US soldiers. If shooting an unarmed person is not murder, than I have do not know what is.

pickme2 : I support the death penalty. It is different then murder. In the case of the death penalty someone has committed a very heinous crime and a court has ordered them to be put to death. In a murder case, most of the time, an innocent life has been taken by someone. The person who took that life may be sentenced to the death penalty for their punishment. What exactly do you think should happen to people who are on death row? Should we forgive them, have a party, and let them all out to commit more murders?

Chow : Im purple. They should have killed her when they first convicted her instead of waiting all these years. The crime she committed was pretty heinous. However, its possible who she is now is not who she was then. Thats why I say they should have did it years ago. This whole thing now though? Its disgusting and so messed up all around. Our system needs major help in all ways
