With all the publicity about Grand Jurys it is obvious many people don't understand what goes on. While I am not a lawyer, ( I have to much integrity for that line of work), I thought a quick look at how they work might clarify the differences and who knows, it make actually educate someone... A Grand Jury is typically 12 persons from the community that are assembled to hear the evidence on Felony cases to determine if probable cause exists to move forward with formal charges and a trial. First what is probable cause? the simple answer is this: the reasonable belief that a crime has been or is about to be committed.  PC is a very low burden to meet in reality. Please keep this in mind as I explain more. The District Attorney presents Felony cases to a Grand Jury. In Texas anytime a life is lost at the hands of another, it goes before a Grand Jury. This includes Officer involved shootings, or any death that occurs as with Police involvement. The defendant in a case may be asked if they wish to testify to a GJ, they cannot be compelled as they have 5th Amendment protection, in most cases the defendant is not present, nor is a defense attorney allowed in the proceedings. The DA in most jurisdictions does not recommend, nor does he/she not recommend charges be filed. The DA presents evidence, most in favor of a charge or charges and lets the GJ decide if probable cause exist to proceed with a the bringing of formal charges. The GJ will issue a True Bill if probable cause exist to move forward, they will issue a No True Bill, also known as a No Bill if they fill that no probable cause exist. A DA can, thought it would be ill advised, move forward with a No Bill if the DA thinks the GJ got it wrong. WHy is it ill advised? If you do not have enough evidence to meet the burden of probable cause, it is a pretty good bet that you don't have any where near enough to get Proof beyond a reasonable doubt needed to obtain a conviction in a trial. In the Darren Wilson, Michael Brown case, the Prosecutor knows it would be a waste to take the case any further, he knows that based on the GJ findings, there is little to no chance of getting a conviction in a trial. I have been out of the system for many years, things may have changed, but that is a quick look at GJ... 4951

Oh man.. you're asking for trouble. I'm sure that pink bear character is lurking in the shadows just waiting to spew all kinds of ignorance in your direction. If so, quote this person in any of your responses. While I am not a lawyer, ( I have to much integrity for that line of work),
 
@dac1842: After reading that special nugget, you lost my interest completely. BTW, you'd have to pass the bar first. Perhaps your "integrity" would just overwhelm you and prevent you from making the cut.
 
Too good for the field of law? I bet you'd be the first one to scream for a lawyer if you were wronged, served or arrested.

You Donnatella have no idea who I am or a thing about me. I would have no issue passing the bar. However my exposure to lawyers early in life convinced me I wanted nothing to do with that profession, and I have only met one lawyer in my life I considered ethical, and I have had to deal with them a lot. I have had several as clients.
The bad rep that lawyers have is well deserved in my opinion.

You can't just walk up one day and say "hey I think I want to be a lawyer" then take the bar like it was the SAT. The way you speak of and disrespect an entire profession shows an arrogance and ignorance that overshadows any intelligence you pretend to possess. 4951

The reason Ferguson keeps going despite all the evidence is that it's a prop.  McDonald's boxes have been used as space ship walls in movies.  The truth of an item doesn't matter for props. 4951

DONT FORGET....grand jury's can ask questions,, and Im sure they asked a lot... they can take notes and look at all types of evidence.If you are ever on a jury,,, Grand Jury is the way to go. 4951

Lol..oh the arrogance of perceived intelligence. I have worked with many attorneys, I have only met one with any integrity. And he would be the first to say, honesty in short supply in that profession. 4951

@dac1842: Then you have spent way too much time with the lower quality ambulance chasers or the type that advertise on TV. You seem to not have spent near enough time with the well-respected business and corporate attorneys where the opposite is true. There may be a few bad apples, but for the most part, they are upstanding and ethical people who just want to do the right thing.
