That when you give notice of leave, that either your manager or the "Employee Leave Checklist" would advise you about the policy for getting paid for unused (but earned) vacation time, right?
 
Not at my company! I gave 3 weeks notice - last day is July 5. My gut told me to call HR today and ask bc I have not seen the issue addressed anywhere in the checklist or in my "to-do before you leave" checklist that my manager assigned me.
 
However, if you go to "MyBenefits" page, click on the "Time Off" link, then click on "Time Off Benefits" link (with the description of: "Includes details about holidays, leaves of absence, PTO/Sick time, vacation and vacation buy") that should OBVIOUSLY tell me more about voluntary termination and what is owed to me, right? Found out I'm losing 28 hours.
 
I'm asking my manager to change my termination date to next Friday now, and I'll eat the other 4 hours, so I can at least get paid for some of my vacation time. (Had I used more than what I earned, I would have to pay it back. But they don't have to pay me for what I earned. WTH?)
 
This craziness is only one of the reasons I am leaving my company. It's impossible to get an answer, the way they send you on a goose chase to find the policy. An this same culture trickles down into the employees who have been there for 15+ years. The "it's not my job" attitude. Grrrrrr....
 
I hope my boss helps me out here. (And I would just call off tomorrow if I didn't have two projects going out - which is why I gave 3 weeks notice, so that I could see the projects through!)

They are obligated by law to pay you any earned PTO. 4951

In Texas an employer is not required to pay any accrued vacation time when you leave, unless it has a policy, in which case it must follow it's own policy.  Check your employee handbook if you have one and see if there is a policy.  Also, in Texas, the employer is free to choose the accrual period for vacation time, so available vacation time might not be accrued vacation time.  I have never worked anywhere that did not pay me for my unused vacation time when I left. Good luck, I hope you get paid, 4951

Yup - Texas is not obligated. It's in the policy handbook (as in, "if you're in one of these 10 states, we have to pay you")... not said" otherwise you're SOL."

We just have standard PTO to cover everything.  In our handbook if you have been here 1 year then you get it when you leave.  They give you 3 days after 3 months, another 3 days after 3 more months then on January 1st if you are new the previous year you get one full day for each full month you worked otherwise you get 17 days for the first 2 years then it goes up like 1 day for each you worked.  You get your days the first of the year and that's it.  If you use the first 6 and leave before I believe a year you have to pay it back.Also, if you start January 3rd you only get 11 days on the first of the next year because you weren't employed a full year.  You have to wait till the next January to get your 17 days.They also implanted a policy that if you use all your PTO and have 4 unpaid days in a year it's an automatic termination.  They also just redid the bereavement policy because someone lied so now in their eyes my in-laws mean nothing.  I get one day PTO if they were to pass.Being the kind of job my DH has I am the one that always has to call in if my DD is sick and he has had numerous medical procedures this year that he was unable to drive himself to.  Now I have 11 hours remaining and have to have some procedures done myself in July so I have to complete my FMLA paperwork to be sure I don't lose my job.Texas is a lot different than NJ.  When I moved here my company cut me a check for my available PTO my last day along with my last check.  No questions asked. 4951

From the Texas Workforce Commision Accrued Leave Payouts Payouts of accrued leave are required under the Texas Payday Law only if such a payment is promised by the employer in a written policy or agreement. The payout would be controlled by the wording of the policy or agreement. If no such policy exists, the company would not owe such a payment.   4951

When I was laid off they were only paying out 50% of your unused PTO....I had a feeling a layoff was coming and took all my PTO
 
@mm4731: Smart. I haven't left a job since 2002, but I would definitely use all my vacation/sick time before even giving my notice. That's the only way to guarantee getting it all.
