Wow, I never expected charges to even be considered against the parents of the baby boy attacked by the gator at Disney.
 
It wasn't a smart move, they should have observed and obeyed the no swimming signs, and I think they should have never taken their eyes off the boy, but the consideration of charges just seems overly harsh. Lapse in good judgment is far from a chargeable offense. Plus, what they are going through now is 100 times worse than what charges could do to them.
 
The thought just seems overly cruel. 4951

I just now saw this. And my last post was a knee jerk reaction because I have a friend whose child died in a tragic accident over the weekend. I don't know the details, but I know that he and his wife were good parents, and they are beyond devastated. I can't imagine anyone pointing fingers at them right now with what they are going through. 4951

I hope they aren't charged! The parents of the boy who fell into the gorilla pit weren't charged. Not much difference. Losing a child is the worst punishment ever. Can't imagine going through this. 4951

Just playing devil's advocate here for the sake of debate only.1. If it were a babysitter would you feel the same about the lack of oversight?2. What if it comes out the parents were impaired with either drugs or alcohol would that change your view?3. We always tend to give parents the benefit of making a mistake when tragedy strikes their child and we call them tragic accidents (which they are) however when an auto accident appears because someone drove and didn't pay attention we call for them to be charged with murder.  Isn't not paying attention the same as not paying attention regardless who does it?Just points to ponder.

I think if it had been a babysitter, they would be angry and blame the babysitter to an extent. But I also suspect they are angry with themselves and will beat themselves up for years. The better question is, would a babysitter jump in the water to try to fight the gator? 4951

@Mahm: I would because no way in hell is it happening on my shift unless I go down too. I would rather be dead than look a mother in the eyes and tell her that her child died in my care.

In any incident where a someone under the care of others dies the police must investigate and submit a report.

An old boyfriend's brother picked up his kid for his normal weekend. He was a bartender and after picking up his son, headed to pick up his paycheck. He had three beers with a friend while there. Clearly not drunk. The headed down the road to get a bite before going to play at the arcade on some go carts.
Someone ran a red light and t-boned him. They hit the passenger side and his son was hit so hard he was in his dad's lap, where he died.
They charged him with dui and got 14 years for manslaughter. The other driver got a running red light ticket.
I thought I was very cruel.
Every day we go about our daily lives. Not one person can ever have eyes on anyone 24/7. Do parents do bone headed things. Yes because they are human.
Justice is blind with tipped scales.
We all must Be careful how we judge another parent unless we keep our children in a protective cage.
I'm pretty sure that's illegal.
I can only imagine the horror those parents are going through.

It was a tragic accident, period. The parents need compassion and our payers, not charges.
However, I would add that if I were right there with my kids, even if it said no swimming, I might let them wade in the water since I was watching. If the sign had said alligators present, I would not let them wade in the water. Other local hotels have the alligator warning signs. This one did not. I think that's more the issue. 4951

Is it common to be lounging around near ANY place where alligators are present? I just don't understand why anyone would even take the chance. I wouldn't let my kids anywhere near that water because it looks disgusting but I'm a freak like that. Bring alligators into the mix and we wouldn't even be close. 4951

I saw a facebook post from another mom who took a picture of her smaller child in the exact same spot just an hour earlier. It seems like letting the kids wade in the shallow water was not uncommon. Sometimes there is a fine line when it comes to being that overprotective hoovercraft parent that doesn't allow their child to do anything that might possibly cause harm even though the likelihood of something bad occurring is extremely small. Do you live in fear that every second your child is not attached to your hip he/she might get harmed or do you allow your child the freedom to have fun. In this case it would seem the parents allowed their child to have a little fun and splash in the water, after all what harm could come from wading in some shallow water for a couple minutes. Nothing happened to the other kids doing the exact same thing. I highly doubt these parents would have allowed their child to wade around if there was any indication that an alligator would snatch him away. This is simply a tragic accident that no one could ever imagine occurring.  4951

@Maisey1: So that being said. Why should Disney then be held responsible?  Interesting they had lifeguards posted even though no swimming was allowed which means they knew people did not follow instructions and if the lifeguards reminded parents not to allow kids in the water then the parents would scream and raise holy heck about it.
 
@Stealth83: Isn't that what property insurance is for? If you invite someone on your personal property and they get hurt you (or rather your insurance) gets to pay regardless of how it happened or who is at fault. A big reason I never let my kids get a trampoline - I didn't need to worry about some kid coming over and doing a stupid trick that results in their own injury then getting to foot the bill via my homeowners insurance and the possible resulting rate increase. For Disney, it's the price of doing business.
