@CBP210  @TheChad  @KingwoodDotCom  @Retired_Engineer  @beastmode  @sooner34 And all the wonderful Gun Owners of KDC....My beautiful hubbs had wanted to Post a Firearm for sale on the KDC Classifieds, but I noticed that it's not allowed, nor on Craigslist anymore, so my hubbs looked on the inner-webs to see what exactly the dealio was, and evidentially there's an Executive Order prohibiting the sell of any/all Firearms, Ammo, etc, unless you possess a FFL (Federal Firearms License).....So, his question is: How is a Private Gun Owner able to sell a Firearm, other than getting ripped off at a Pawn Shop?     4951

You can use a local guy in Kingwood who is as a FFL dealer and sell it on consignment, Dam forgot the guys name... 4951

@Sniper12: I think @RetiredEngineer has a list of FFL holders that will work with you in the surrounding area.

@cgm10sne1  @QueenBWith this new Executive Order, from what my hubbs found out / read Online this evening, it prohibits the sell of any Guns, Ammo, etc etc, at the Gun Show, unless you are able to perform a Background Check, have the necessary Documents and possess a FFL (Federal Firearms License)...  4951

I was not aware of any new Executive Order that restricts the sale of personal firearms.  It's getting late so I will investigate it more tomorrow.EO or not, it makes sense to use an FFL holder to do a background check on the person you sell the firearm to.  This will insure that you are selling to someone that is legally allowed to own a firearm.  Typically, FFL holders charge $20-$30 to have the buyer fill out the paperwork and then do a background check on the buyer.Holders of a CHL (now called LTC for license to carry) that buy a firearm still need to fill out the firearm sale form, but do not need a background check.  The paperwork is ATF form 4473 and can be downloaded from the internet.  If they have an active CHL/LTC, you can have them fill out the form, enter their CHL/LTC  number on the identified box on the form and no additional background check is needed (that was done when they applied for the CHL/LTC).  These forms are NOT sent to any government entity (because that would amount to gun registration), but the seller (or FFL holder) must keep the completed form and show it to the ATF if/when requested.  FFL holders are familiar with the quirks of the form, so it is well worth having them handle it.  As the seller, you probably should ask for a copy of completed form 4473 for your records.Many classifieds (like KDC and Craigslist) made a business choice not to advertise firearms.edited:  If the EO includes ammo to require a background check, it is either an EO that was over-ruled or a hoax.  I order the majority of my ammo over the internet (ground delivery by UPS, FedEx, etc.) and the only thing some of them want is proof of age. 4951

"  Clarify that it doesn’t matter where you conduct your business—from a store, at gun shows, or over the Internet: If you’re in the business of selling firearms, you must get a license and conduct background checks. @herron1345: That sounds a bit scary to me, I can understand the need for control but to make it illegal to sell unless you have a license to sell is a bit more than I expect.
My understanding (not saying it is correct) was that the buyer needs a permit. The permit is issued at the courthouse (of the county where the transaction is made).
A wait time for completion of a background check is required.
But the county/state performed the checks, issued the permit and charged the buyer a fee for their effort.
I'm probably all wet because I seldom buy new guns. I've owned most of them for years.

I have check with many buds and they mention this below. A friend of my just bought 2 shot guns from active duty HPD officer and just did a bill of sale transaction....The system is riddled with loopholes. The most well-known way to bypass background checks is the private sales loophole: If someone purchases a gun from a private seller, such as a friend or family member, no gun background check is required. This is often mischaracterized as the "gun show loophole," under the assumption that people can simply go to a gun show and buy a gun without getting a background check. But licensed dealers at gun shows still have to carry out a background check. The actual loophole is that someone can meet with a private seller at a gun show — or increasingly over the internet and buy a firearm from that person without a background check. In other words, the gun show doesn't create a loophole; the private sale does. 4951
