File a complaint with the state medical board and a malpractice lawsuit? I have never done this before. Doctor told my husband to suck it up and do 3 physical training classes and go back to work. When we went to another doctor 6 weeks later because it was not getting any better, we found out his hand was broken in several places. Old doctor has had him on 500mg of ibuprofen 4 times a day for 6 weeks now. Not good for his health, which i expressed my fear of him being on it so long. New specalist said he was basically off work for the last 6 weeks for nothing because all he kept doing was injuring him self more since he didn't have a cast. So this doctor basically extended his pain and heeling time by 6 weeks. And his loss of income. Not sure if our claims adjuster can help us since it was an on the job injury. Thanks for the help in advance. I'm off to support the family since I'm the only one working...lol. 4951

Is your husband getting care through workers' comp? If so, I would think they would have to pursue this. Call the Houston Lawyer Referral Service: hlrs.org/ and speak to them. They will get you in touch with the correct lawyer and you can speak with them over the phone (or maybe in person?) for a $20 fee. I had to use them last year when a jackhole we hired to take trees down caused all sorts of damage to our property. We had no written contract, he agreed to walk away when I started getting quotes to fix everything... then tried coming back for half the money due to our verbal contract. The lawyer was a real help to us! 4951

That's what I was thinking. This whole issue came up because he had to go weekly and she never spent more then 30 seconds in the room. Then we had to wait 45 minutes for a note and I was aggravated. We never heard back on a doctor reassignment for 2 weeks so I decided to pay the co-pay on my personal insurance for a second opinion. 2 weeks pass and my husband calls the claim adjuster and she forgot. A week later he gets a call for his appt this morning he just left. I feel it was really both their faults. A doctor that can't diagnose a broken bone and a claims adjuster that can't schedule a doctor's appointment. 4951

The first step is to contact a Worker's Comp attorney. Google it for Texas and you will find results. They work for the patient, not Worker's Comp. The attorney will request all medical records, thoroughly review them and let you know if you have a case. I've been out of the medical field for many years and have forgotten some information (and rules change), but I seem to recall that the attorney only gets paid IF you win. The atty's office will let you know.
 
You also have the right to go to any Worker's Comp provider that you want. He is not restricted to go where his company's insurance tells him to go. I highly suggest finding your own doc.

Dr. Henry Small is a good orthopedic doctor. Contact his office and they will tell you if he is a Worker's Comp doc and if he treats hand injuries. If not, they may be able to direct you to someone who can. He's a really good guy, but not who I worked for.

Good luck, I knew a gut that had a surgical "rag" if you will sewed back up inside him, took a year to find a lawyer that would take it, then he said by the time they settle, he would get nothing after fees basically. 4951

@Nicole4647:  WC doctors are very quick to tell people to suck it up and return to work because, unfortunately, there are so many bogus claims from people just trying to scam the system to get paid to sit at home and watch trash TV.  That grossly misdiagnosed injury is worth pursuing.  A simply x-ray with competent medical eyes would have seen those fractures.

Just to add fuel to the fire his WC doctor told him during his last appt that if he had done physical therapy he would have already been doing better. If anyone knows how physical therapy heals broken bones I would love to know...lol. However when he did try to schedule physical therapy it went straight to voicemail. He called (we have records) once per hour and left a voice mail each time for a week with no returned calls. When his claims adjuster called to check on him he told her what was going on. A week later she called back with an appoinment but this time he demanded a new doctor. A week and a half goes by and here we are now. He has had a broken hand for 6 weeks with no cast and no pain medicine that is safe to take. All he wants is to go back to work but his work doesn't have light duty so he has to wait longer. I knew something was wrong when they sent him to a minor emergency room in Gunspoint and we couldn't pronounce the name. Now the closest hand doctor is in Tomball.

Same thing happened to my husband many years ago, except it was his BACK! The insurance company would only authorize occasional physical therapy appointments. He walked around and continued working like that for a year! 4951
