A lady at the bank was saying someone was put out of their house by the home owners association, near Woodlands Hills........does anyone know anything about that? 4951

@BaiLiFan: Is it possible this story below has been stretched to the fable you mention above?https://www.kingwood.com/message_board/view_message.php?message_board_parent_id=1299452&message_board_category_id=0&ampEmoticonage=HOA's don't have the right to impose liens on properties, as far as I know.  If they do, the lien would not be sufficient to "put someone out".  Banks, on the other hand, fully have the right to do so when loans are not paid.

No - that is not the correct story.  The home was abandoned by a family and trash was strewn all in the yard.  The owner/son is an attorney and they had been asked for years to clean up.   The media came out this morning and confronted the woman who would come by and dig in the garbage looking for things to keep.  Nobody was put out or told to move.   They already live elsewhere.http://abc13.com/news/neighbors-fed-up-with-kingwood-home-filled-with-trash/974941/ 4951

Actually HOAs can, a more famous story from Texas a few years ago...http://www.npr.org/templates/story/story.php?storyId=128078864&ft=1&f=1003I believe this incident drove Texas to look at tightening the law to prevent something like this, but it is still possible through the correct proceedings.  4951

I was told recently they can and will/do!! And if they do you can't sell your home until you settle the debt. try going to closing and there's a lien and see what happens. Before every close there's a discovery done, if the bank/title company finds something you must settle it and bring a cashiers check to cover it. 4951

I will agree that some HOAs have very strict guidelines and powerful boards who enforce them swiftly and diligently, including fines, legal action and liens. Kingwood is known for great deed restrictions to prevent cases such as this. However, in this case, the HOA, City, and Health dept failed to do their job. Neighbors and Media worked together and the issue was resolved. 4951

My neighbors house just had the locks changed by I believe Wells Fargo.  It has been empty for 3 years this past August besides the squatters that lived there for a few months and it has been in bankruptcy forever.  It is in Woodland Hills that's why I was asking.  HOA had nothing to do with it though. 4951

The HOA's are limited in what they can do...   The laws were changed a few years ago after a case that was cited above.....   They can put a lien on a home which must be settled prior to you being able to sell your home. 4951
