Kate Steinle was walking on a busy pier in San Francisco with her father when there was a single popping sound in the air.She fell to the ground, struck by a bullet, the victim of what police say appears to be a random killing. The man accused of firing the deadly shot -- 45-year-old Juan Francisco Lopez-Sanchez -- is an undocumented immigrant, a repeat felon who has been deported five times to Mexico, according to immigration officials. It would have been six, a federal law enforcement source told CNN, except authorities in San Francisco wanted him on a drug-related warrant.So U.S. Immigration and Customs Enforcement, which had Lopez-Sanchez in its custody in March after his release from federal prison, turned him over to San Francisco deputies. ICE said they requested an immigration detainer, asking that the agency be notified before Lopez-Sanchez was released. But San Francisco is a city that doesn't honor such requests and the sheriff's department released him. Freya Horne, chief legal counsel to the San Francisco County Sheriff, told CNN that he was let go because there was no legal cause to detain the suspect. On Wednesday evening, he shot the 31-year-old Steinle at Pier 14 once in her upper body, according to police. He was found about a mile away an hour later and arrested.Suspect had seven felony convictionsICE said it turned Lopez-Sanchez over to San Francisco authorities on March 26 for an outstanding drug warrant. The agency requested an immigration detainer, but Horne said San Francisco officials believe that violates Fourth Amendment rights against unreasonable searches and seizures. The sheriff's office said, "When Mr. Lopez-Sanchez was booked into the jail, there was no active Immigration and Customs Enforcement (ICE) warrant or judicial order of removal for him."The department would have returned Lopez-Sanchez if there had been a court order or warrant, it said. Charges were dropped March 27 but Lopez-Sanchez was held until April 15 while the sheriff's office determined there were no other warrants for his arrest and he had completed his federal prison sentence.According to KRON, San Francisco's policy on undocumented immigrants "states that a law enforcement official shall not detain an individual on the basis of a civil immigration detainer after that individual becomes eligible for release from custody."The federal law enforcement source told CNN the sheriff's department "didn't even need to hold him. They simply could have notified that they were going to release him and we would have gotten him."Police said Lopez-Sanchez last lived in Texas, where he was on probation. ICE said Lopez-Sanchez has seven felony convictions, four for drug offenses. His most recent deportation was in 2009.He was released from federal prison in March after serving several years for felony re-entry after deportation.Lopez-Sanchez is in San Francisco County Jail and faces a homicide charge. ICE has requested another immigration detainer.

@Sniper 12    I read that this afternoon also & decided I don't want to read the news anymore. What a beautiful young girl. This country has been hoodwinked by that gross imitation of a President.  This isn't a democrat vs. republican thing. This is evil vs. good.  And that man is EVIL. He is totally destroying this country.  But our representatives in both parties are too worried about lining their own pockets than putting a stop to him. He was told to scrap his amnesty program & he just ignored the court & plans on going through with it.  He also needs to stay out of private business. This regulation/law he wants or did pass about the over-time pay is not going to help the middle class one bit. All it will do is have companies not offer management positions and keep peoples wages lower or have the companies leave this country and there will be even a bigger problems with employment, like no professional jobs or jobs to support a family. It's getting harder already & this hasn't even happened yet.The good people of this nation need to stand up to the dredge of society who are offended by everything. It's just plain sickening!OK my rant is over......... 4951

A savvy criminal can easily find a way to re-enter this country,  even 5 times and more.  The border is very long, and there are many places to get through. I don' t know what we can do to keep every bad guy out.
 
@justanirishgirl:  Did you not read the article? He was LET GO by law enforcement!!! They could have  held him, pressed charges, etc. but chose not to.  And, yes, there is a lot that can be done so we know who is coming into our country but the federal government has chosen to open our borders as wide as possible.Have you heard of the "rape trees", by any chance? Google them and see if the kinds of people who are raping girls and women are the types we want in this country. If not, t hen ask yourself, why has  it continued, non-stop, over the past few years, especially.

I'm NOT at all a Donald "comb over" Trump fan, supporter, or promoter, but seeing how he has stood his ground, hasn't tried to "back peddle" on his comments, hasn't tried to "Spin" his remarks, and hasn't caved into the Political Correctness abyss, which is disgustingly rampant these days,  has earned Mr. Trump my respect, at least in that aspect...

@thegoodwife: The federal government had deported this man numerous times in the past.  The feds requested SF to not release this individual without notifying them so that he could be detained and deported-again.  Had SF honored this request this young lady would most likely be alive today.  I realize the above is your opinion but I'm having a hard time trying to figure out what role the President of the United States played in this?

This govt should never allow any state to be a sanctuary state. Funny the govt can sue and take states to federal court over voter id and whatever else him and the state dept disagree with but he allows states to be sanctuary states. WTH? No new laws needed just enforce the ones we have.

@sweetie: I'm not aware of any whole states that have declared themselves to be a sanctuary for illegal immigrants.  But I do know of cities that have embraced that philosophy including Houston.  To that end some of these cities were doing this long before President Obama took office and I suspect many will continue to do so long after he leaves.  Further it seems to me that governors probably have more influence over city political leaders in their states than the president in regards to this issue.  In any event I don't believe in sanctuary cities.  But you know as well as I do immigration is a hot button issue.  Secondly, most immigration cases involve an administrative process as oppose to a criminal one.  It is that distinction that San Francisco authorities used to justify not notifying ICE when this man was released from their custody, which as we all know had tragic results.

I was born and raised in San Francisco and left when I was 24.  The crazy liberal nonsense is the reason I will never go back to live.  Heck, I haven't even been back to visit in close to 10 years.  My whole family has up and moved to Arizona almost 10 years ago.  It's a beautiful city, and I consider myself blessed to have been raised there, but the bleeding hearts that don't think with their heads have ruined this place! 4951

A couple of years ago, Governor Jerry Brown signed a bill making California a sanctuary state. My niece lived in Maryland , and Baltimore and several other cities are sanctuary cities. New York is one too . Rocket you are right it's only one state but a lot of cities. States should not allow it. Mea culpa . 4951
