No.  I have a letter from the fire marshal in my desk drawer about it (got one after a neighbor of mine got bent out of shape). I contacted the fire department on the subject and they were kind enough to send me a formal letter to show my neighbor.Legal.  Must be contained.  Must have extinguishing agents nearby. 4951

@Katiemcg: What kind of fire pit are you talking about? One of the things you can buy, or a homemade one? Technically no if your doing the fire pit in your front yard. HOA would have a cardiac arrest over that. If it's in your back yard, it could also be an issue. Do you have it as a small leisurely fire or are you trying to have a "Lord of the Fly's" kinda fire?Tell your neighbor to get his/her panties out of a wad.  4951

It's a small store bought fire pit. We are burning off old fencing, trying to get rid of it. In the backyard of course. It's not a huge fire but I guess he could see it because his deck is elevated. He's always got his panties in a wad so whatever. It's just that he tried to say it was illegal, and I know that just can't be right. 4951

@Brat: I have several neighbors who lights them up constantly in their front yard and they never get a letter from HOA. But then again I am no complainer as my daughter goes and roast smores with their kids.

I guess my concern would be if someone was burning treated lumber- it contains all sorts of nasty chemicals which could do some serious damage to lung tissue when inhaled. 4951
