A good friend of mine is wanting to file papers to divorce his crazy, currently separated from, soon to be ex wife. There are no children involved, he works & makes good money but she basically does not work. He pays everything, apartment is in his name, she has been using his car that is in his name but doesn't have a car of her own, etc. Does he need to file with an attorney even though there aren't children or an estate involved? Or can he just file at the courthouse himself? If he does need an attorney, any suggestions for a good, reasonably priced one? What steps need to be taken? Anything he should do personally before seeing the lawyer? Drain his bank account? Any info helps as he isn't familiar with divorce & as a friend, I'm not either so I've got nothing to contribute. I was fortunate to divorce my first wife and we had no kids. I went to the courthouse and filed myself even though I talked with an attorney later for more advice. It does not hurt to talk to one just to be in the safe side. 4951

He can do what he wants but even if it's not in her name and she didn't work, Texas is a community property state. She gets half, even if it's not in her name. If they have been married at least 10 years she may be eligible for spousal support. I believe it is unlawful to try and hide assets like draining accounts.. 4951

She gets half value, doesn't mean she gets an item.  She can only get an item if she can afford to pay half the value back to him.It can get messy.

It does get tricky because if he decided to keep it, he can be made to purchase her half and give her the money. 4951

newly single crazy is good, shes **** off and focused on him but uses you for hardcore revenge sex
 
@mm4731: Good tip!  Not what I was thinking but good info.
Anyway, if she is crazy enough it might be best to fake one's death and leave the country.  Might be the best divorce plan. 4951

If it is uncontested you can file at the courthouse and not need an attorney. You have to wait 61 days (called the "cooling off period") before it can become final. I'm going through this right now.
 
And by the way, come mid-March I'll be available for that revenge sex. 4951

She's the kind of crazy that's been diagnosed bipolar that's landed her in jail for domestic violence before. Unfaithful. Just plain crazy. She has no income right now, she was basically mooching off of him & using him for his money. Would filing at the courthouse & leaving lawyers out of it be best? She can't afford an attorney. 4951

@ThankYou: What happened in my case was my ex wife did not attend any of the scheduled hearings and I won my divorce by default so no spousal support or property division. This was in California. Your friend would have to serve her with the papers and have a process server do it.
