After just seeing the entire video, which is quite disturbing, as well as saddening, and hearing Eric Garner, in sheer anguish, notify the police officers that he "could not breath," as well as hearing the Coroner's Report ruling his death a  "Homicide," I honestly, and wholeheartedly, believe that the police used unnecessary, overly force, in this incident, and the officers involved should have been indicted....... Especially the officer shown using the choke hold, which was completely against the policies of the Police Department, and resulted, in my opinion, in the death of Mr. Garner....  4951

All he had to do was comply with the officers demands.
 
Yes the choke hold was unnecessary and I believe the officer needs to be held accountable for excessive force that caused a death. But at the same time this should be a lesson not to test cops.

Taking race COMPLETELY OUT OF THE DISCUSSION, it was an individual breaking the law, stopped by police, who resisted arrest and fought with the officers. I'm sure they hear all kinds of excuses and "pleas" to let go, ease up, ouch that hurts, etc. from suspects trying to get a little slack so they can fight or break free. Had he just be a regular law abiding citizen doing his own thing, he (1) wouldn't have been stopped (2) wouldn't have been restrained had he not been be resisting.
 
Lessons Learned:
 
Don't be a criminal.
Cooperate if you're stopped.
Even if the cop is a first class ***hole, be respectful.
If you are being arrested, don't resist 'cuz you're going anyway.
 
That goes for anyone regardless of race. 4951

@donnatella...I agree to an extent with your stance, but dude, but in this case, I witnessed the video, where Mr. Garner is down on the ground, surrounded by multiple officers, not  resisting or acting in any type of threatening manner, in my humble opinion, and all of the while, a police officer, is shown using an unnecessary choke hold method, which is in complete violation of the police departments regulations....So, this officer, not only violated the police departments rules, but in my opinion, used excessive force, that just wasn't warranted, and that unfortunately resulted in this man's death....    4951

The dude had 31 arrests since he was 16. His past was bound to catch up to him. I don't have much sympathy for career criminals. 4951

The dude had 31 arrests since he was 16. His past was bound to catch up to him. I don't have much sympathy for career criminals.

Look at a few other facts from this case.NY has the highest cigarette taxes in the nation.  DeBlasio had recently ordered a crack down on black market cigarette sales.  He had demanded arrests and examples made.NY City resells confiscated cigarettes at auction, BTW.A minority business owner had called police because Garner was selling black market cigs outside the owner's business.  It was hurting sales of cigarettes because Garner was undercutting the price: he didn't collect the taxes.A black precinct chief ordered the arrest.  The cops on the scene were under the supervision of a black, female sergeant.  Racism?  This wasn't a rogue, racist white cop going after an innocent black guy.  Choke Hold?  The coroner found no damage to the wind pipe or the neck.  Garner did not die of asphyxiation. When judging a case like this, a grand jury looks for malice and intent to injure or kill. @fcabanski: The root cause was not the government collecting high taxes. The root cause was a guy that had 31 arrests from the age of 16 to 43 (time of death). This was a guy that felt like the law didn't apply to him. Just because NY charges high taxes doesn't mean this guy can circumvent the law. The root cause was his criminal mentality and lack of learning from his 31 prior mistakes that ultimately caught up to him.

@WskyTngoFxtrt @fcabanski..Dudes....  I had absolutely NO clue as to the 31 prior arrests and warrants........When my hubbs and I were watching FOX News last night, O'Reilly simply stated that he had "non-violent offense arrests prior, but nothing serious"... ....And never went any further into detail.........And O'Reilly DID in-fact state that, according to the autopsy/coroner's report, Mr. Garner died of asphyxiation, directly resulting from the choke hold....  ....And this was on Fox News....  ....The O'Reilly Factor, to be more specific...And now, after hearing these new facts come to light and into play, my views have slightly wavered since my original post and starting this thread, but I still insist that the choke hold, and use of force, seemed excessive, in my opinion........Especially with having multiple officers right there on the scene....  ....And having tasers they could have very easily used if the suspect had gotten out of hand....  ....Now, with that being said, I agree wholeheartedly, one hundred, that any attempt to play the blame game, and the sheer stupidity of trying to say the government is at any fault here, is completely lunacy....  ...Ummmm.....  Hello......  Personal Responsibility, anyone.... 4951
