If you are a passenger and the driver is pulled over for whatever the reason. If the cop comes over the driver side and ask you (the passenger) to provide ID or get out of the car, do you have to oblige? If you refuse to get out of the car do you think they have a right to apply force? 4951

Question is too generic. Probable cause depends on what the officer sees and hears.I do know that if you refuse to show your ID, they will think you have something to hide! 4951

yes, you have to oblige,, the passenger also did not have his seatbelt on.When you are stopped the officer can and most times ask all occupants for identification. Based on what I can tell the passenger refused and so did the driver. With the stop for seatbelt violation, the officer has probable cause to ask for identity. you are not seeing the entire video. They ask several times for the passenger to give his id. The driver then rolled up the window, and they refused. Upon that, they are obstructing an officer. Nobody ever said there was or was not a gun or even dope, or other items in the car. The news is only showing one side of the story.Remember the Rodney king Video... did you see the part where King was in a car chase, then beat up 2 officers who went to the hospital. No most people didn't, all they saw was the press version, of the police hitting King with the batons. They never showed King hurting 2 officers. By the time the press only showed the beating part, the 2 hurt officers were pulled back.again,, ones side of the press news. 4951

Okay, I am hearing so many different things its hard to understand what my/others people's rights are. I can understand to a degree, if I am a passenger why the police would need to speak with me about anything since I am not the driver.
 
 If we are pulled over for speeding or no seat belt, then right the ticket and we can be on our way once it has been determine we haven't done or committed any crimes. 4951

I agree, They are the Law and when they ask someone to show ID it's best to do it. They are doing there job so for me it's yes sir! or yes Mam. 4951

@KTownTexican: So, you have heard of this case too? How are we supposed to know what we can and cannot do? Some things need to be taught to the public so we can know our rights, I don't know enough about the law other than the law of the land for my driver's license and CHL. 4951

Probable Cause & Reasonable Suspicion Many factors contribute to a police officer's level of authority in a given situation. Understanding the what, when, why, and how of police conduct during a stop is confusing for most people. Varying standards of proof exist to justify varying levels of police authority during citizen contacts. While Know My Rights maintains that it is never a good idea to consent to a search or to answer incriminating questions, a working knowledge of these standards will help the citizen better understand when police can surpass constitutional protections.Reasonable SuspicionA police officer has "reasonable suspicion" when there exists articulable facts or circumstances which would lead a reasonable person to suspect that a crime has been, is being, or will be committed.At this stage, police may detain the suspect for a brief period and perform a frisk. In some cases, drug-sniffing dogs may be called to the scene, although officers must cite a specific reason for suspecting the presence of drug evidence. Refusing a search does not create reasonable suspicion, although acting nervous and answering questions inconsistently can. For this reason, it is best not to answer questions if you have to lie in order to do so. Police authority increases if they catch you in a lie, but not if you refuse to answer questions.
