Anyone know if there is a statue of limitations on a civil suite for non-payment after house repairs that was completed back in 2008? I rehabbed a house for someone a personal acquaintance, they never repaid the $9,000 I spent. Would like to get that back, I still have every little receipt from the job... They paid a little back in the beginning but then stopped and obviously they have no intentions of repaying now.Is this my loss now or can something still be done?  4951

If they have made no payment and you made no "legal" effort to receive payment I believe its 4 years. The 4 years starts from the first default date. If you sued and got a judgment it stays on their credit for 10 years but I believe you can only try and collect for 7 years on a judgement. I may be off a year or so but last I checked that was it. 4951

Suing them won't get you the money, only a judgment so unless you KNOW they have it, I wouldn't bother. 4951

Couldn't you have put a contractor lien on their home?

@BooBear: But if he puts a judgement against the house he did the work on they can not sell without paying him first and he can add interest onto that judgement.Of course most work around this by renting the home out instead of selling it or gifting the home to a family member. But atleast it stays hanging over their head a while!

I waited because I was trying to work with the other party, then they lied, then they reimbursed a little, then they decided to not do a thing about it and then I didn't have tons of money during some of that time to hire an attorney.. and now it's clear nothing will come back, so now I am in a better position to hire an attorney if I need to.. plus I was in a multi year custody battle myself which took a lot of my resources. 4951

do a free consultation with an attorney, most will do a free sit down with you and discuss your fees VS your winnings and whether its worth it...at 9 grand Im gonna guess it wont be worth it with a lawyer but possibly small claims with no lawyer and a lien to make life a bit hard on them but you probably wont see any money either route you take and a lawyer route will cost you even more money. 4951

I looked it up, and it seems the statute of limitations is 4 years. I don't understand how people can just not pay for something. What ******s. I would ask an attorney to be sure. 4951
